  acceptable usage policy

jphostworks does not monitor, control, or restrict the content stored or transferred on its network any more than is necessary to ensure the stability of its infrastructure and the quality of its services - collectively "the jphostworks network". jphostworks clients are bound to abide by the guidelines contained in this Acceptable Usage Policy in order to ensure they do not jeopardize that stability and quality.

content

/legality/ clients may not use the jphostworks network to store or transfer material or to act in any manner which is illegal, which supports illegal activities, or which may give rise to actions in contract or tort. The definitions of "illegal" and "tortious" are those determined by the laws of the United States, Australia, or the country in which the client resides.

/intellectual property/ clients may not violate the intellectual property rights of others.

/adult material/ clients may use the jphostworks network to store or transfer adult material only in so far as all other requirements set out in this document are met.

/export control/ clients may not violate any export control regulations set down by the United States, Australia, or the country in which the client resides.

/spam/ clients may not use the jphostworks network to originate or distribute unsolicited commercial email or to host a web site referenced by such email.

resources

/disk usage/ clients may not use more disk storage space than that provided by their service agreement.

/bandwidth usage/ clients may not use more network bandwidth than that provided by their service agreement.

/processing and memory usage/ clients may not use processing or memory resources to an extent which interferes with a server's ability to meet other clients' resource needs.

/over-usage/ jphostworks reserves the right to charge additional fees for any client's over-usage of resources.

/services/ clients must not provide anonymizing/proxy HTTP services, anonymous FTP services, SMTP relays, or IRC proxies/daemons via the jphostworks network. Additionally, the following forum software is not permitted: UBB, YaBB, IkonBoard, PHPNuke. Clients may not install background-running processes.

security

/passwords/ clients must not share any password which provides access to the jphostworks network. If a client has reason to believe that their password is no longer secure, they must inform jpwebworks.

/network disruption/ clients must not use the jphostworks network in any attempt to disrupt or gain unauthorized access to any resource, computer system, or network.

privacy

/third-party information/ clients must not use the jphostworks network to collect personal information about third parties without their consent, or to make available such information.

violation

/determination/ jphostworks is the final arbiter in the determination of a client's violation of this AUP.

/remedy/ jphostworks may take action against violators of this policy in accordance with its Terms of Service.
